Retained an attorney..........Lookin at April filing

    Retained an attorney..........Lookin at April filing

    I reside in Missouri. --Retained attorney on Friday............ probably looking at April filing. 80k in cc debt. I was current on everything until last week. We have been living on cards due to unemployment since July.

    Anyway -- gonna have to use my cards for a couple more weeks -- but that should not be a problem for small stuff (trips to the store, fuel, etc.)

    However, I did have my water heater quit.........had to order one from Lowes yesterday - so that is a big purchase after the attorney told me to stop paying and stop using. I hope that is not a problem - but it was unavoidable.

    Anyway - for smaller living expenses is it really that much of a problem to use them up to the point they shut them down for late/ nonpayment? I do have employment now and my wife works also, but we are trying to get caught up back to piece of mind. Thanks for the input

    Using your CC's after retaining your attorney could be considered fraud. You run the risk of those charges not being discharged. Especially the larger charge for the new water heater.

      some districts ask when you retained an attorney; so i would be careful with the charges...

      I would stop using the cards alltogether. The cards can dispute any charges since you would be making them knowing that you would be filing later in the year. Unless you don't mind paying it back...

        Thanks............and yes we will stop using the cards completely. The water heater thing was completely unforeseen - so if they dispute it, I guess I can pay it back if it comes down to that.

        One thing I forgot to mention is that I asked the attorney if I could get new tires for the vehicle - they were unsafe and worn out. He told me to do it in the next few days and I should be OK - so I did. He did indicate the worst that would happen is the trustee would make me a cash offer for the tires.............say I pay half of what they cost? I thought that was interesting. I am figuring if I have to..........and dont get garnished, I may wait till June to file.
