I have a question about my non-filing wife and her allowable expenses in schedule J. I am exempt from the means test (non-consumer), so schedule I & J are the only things that will be looked at.
My wife has many expenses that are higher than the IRS standards. She buys a fair amount of clothes, her hair appts. are expensive, manicures, general shopping for herself, etc. We make good money and she has a good so i certainly don't mind. But how will these things be treated in schedule J? Are they listed separate from our combined household expenses like groceries, housekeeping, etc? I would say she spends more on things like going out to eat, entertainment, etc. Is a trustee or UST allowed to object to her expenses if i can document them since she isn't filing? Or are they combined for both of us?
I am trying to get the Schedule I & J difference down. Also, can she borrow money before the bankruptcy since she isn't filing. She would like to eventually start a tutoring business (she is a teacher), and this would go towards advertising, etc. I assume since she isn't filing, she can do that if she wants right? And the loan payment can be included in her expenses?
