    Just a couple of questions..

    I have a couple of questions, My husband and I are surrendering
    an investment property in Vegas , we filed Chapter 7, on Sept 11 and our hearing was on Oct 15, 2009, we had this property
    on the market but no luck, the realtor now has a buyer-short sale of course.
    BOA wants us to send them paystubs 6 months worth and bank statements.
    I do not see why a short sale would help us etc or is this just helping the
    realtor, she is working on this even though we did not re sign the realter
    agreement extending the contract

    We are being billed a water bill on an investment property in Florida. we put the water in our name as we were trying to rent or sell the property..We are not the legal owners of the property. and it is being foreclosed on now.
    I thought this bill was taken care of but they have re -started to send us the bill. We do not own this property and asked many times for the water to be turned off, they won't ,the bill has gotten to over $5,000.00.
    I did not list this bill on our case and want to know what to do.
    Please help..

    I would add the water bill to your petition. It costs around $30 to amend your petition and add more creditors. As long as you add the water company to your creditor matrix before you are discharged you should be fine.

    If you have filed for bankruptcy, then nobody should be trying to sell an asset without the approval of the trustee at this point. I am not sure what is going on, but is the trustee aware that the realtor is trying to sell the property?

      Has your trustee given permission to sell this property? If you are surrendering it, what in the world is a realtor doing trying to short-sell it? If you didn't sign an extension of the realty contract, the realtor has no right to be representing you any longer.

      Who have you told about this situation? (And please tell me you filed with a lawyer given the complexities you're describing here.)

      Whoa....back up. You said you were trying to "rent or sell the property" but also that you "are not the legal owners of the property." Can you explain this in more detail? How have you asked for the water to be turned off? Have you notified the water company in writing?

      You put the water in your name and the water apparently is still being used on the property. Any charges for water on the bill from after the date you filed is yours to pay. However, you can discharge whatever was owed up to filing day by adding them to your forms.

      Again, I hope that you have a lawyer because this is a mess.

        My husband hired the agent months before we filed but the house didn't move then someone came along and they put together a short sale but BOA took forever we thought it was a dead deal, then we filed. THe sales contract had run out anyway.. Our agent and
        the buyers agent are trying to get it through now. I have told my husband that
        we can't and it is out of our hands and we have to tell her to back off etc.
        She says she is getting pressure from the buyers agent etc.
        I know we can't sell anything.. that it is out of our hands. The agent wants
        our attorney to ask the trustee to lift the motion .

        The investment property in FLordia was a property that another invester and
        my husband worked on ,we are not the legal owners It was to be sold or rented but we went ahead
        and got the water hooked up because of the grass , it has a automatic
        watering system. The bills never went over $32.00 a month and
        then we got a bill for $2000.00 We asked them what the problem was and they told
        us it was a pipe leak (new constrution) we live in WA so we didn't have a way to fight it, we told them we would make payments but to stop the service and they refused saying they couldn't
        cut off service.. we paid for a while but the fees continued and we stopped paying,
        and now the bill is over $5,000. We have talked with them and
        we go around and round trying to get the water turned off and
        get our name off the bill. We are not the legal owers , the owner has filed bk7 and the property is in forecloser. We have never lived there and they told
        us to send us confirmatin of the BK7 . I guess we should just add them
        to the petition. Yes it is a mess.

        Looking forward to having this all behind me.
