    notice of appearance on pacer

I just saw this on Pacer. My 341 is on Dec 8th.

Full docket text for document 10:
Notice of Appearance and Request for Notice Filed by (creditor name removed)

Notice of Appearance and Request for Notice with Certificate of Service Filed by (name removed), (lawfirm removed) on behalf of (creditor name).

Does this mean they intend to attend my 341? I'm so scared

Usually a notice of appearance just means that they want to be notified. But if it is Ramesh Singh, he files in, well I think about 60 percent of BK's for no reason. No one knows why, but he does and does nothing. So basically it depends on who it is and what kind of creditor it is.

Well, I found a little information about him here: http://www.recoverycorp.com/privacy.htm

              Ramesh Singh
Financial Controller at Recovery Management Service Corporation
              25 S.E. 2nd Avenue, Suite 1120
              Miami, FL 33131
or by sending a facsimile to RMSC at 305.374.8113
or by sending an e-mail to [email protected]

This is what they do: Bankrupt Account Processing
              & Workflow recovery Management
-------------------------------------------------------------------------------------------------------------------Bankruptcy and portfolio managers must struggle with the following challenges on a daily basis:

              • Processing large volumes of court correspondence
              • Missing accounts during location process
              • Complexity of entity matching
              • Case information remaining static
              • Prompt removal of bankrupt accounts from collections
              • Prompt return of accounts to collections upon case dismissal.
              • Seamless integration between all bankruptcy processes.

Of course that is from their own website so the reality can be different. But it looks like creditors hire them to keep track of the BK cases.

Ok...a little further look at his site and he claims to "proactively find asset cases" which I take it to mean he files against any case he can find in hopes there may actually be assets!

Look at his website here: http://www.recoverycorp.com/svc3.htm

Here is a copy of just one small part:
              The RMSC Solution
-----------------------------------------------------------------------------------------------------------------------------------------RMSC's state of the art technology allows our clients to be confident that every possible claim which can be filed, is filed accurately and on time. Our system does not solely rely on mail handling, but proactively identifies asset cases.

Our POC processing and the bankruptcy processing engine are completely integrated to ensure that a claim is filed for every bankrupt account identified as having assets. Every claim is constantly monitored and we contact the trustee in the event that the status of the claim is unclear.

Our POC call center handles trustee calls, and POC specialists respond to objections filed. All checks are processed in an automated but audited fashion, under the supervision of our specialists, minimizing human error. The system is completely transparent with audit trails in place.

Just curious, does it cost money for a creditor to file a claim or notice of appearance to the court? If so, then this Ramesh Singh guy, he certainly gets around with so many notice of appearances to these BK filers!

Oh my gosh, this is nuts! I just did a search because I found this same thing on my PACER case, same guy. That's crazy!
A fresh start is a beautiful thing. And I'm not an attorney, just opinionated!
