    Look at the case of, In re Addison, 540 F.3d 805 (8th Cir. 2008). Sorry, don't have a link, my few initial google searches didn't find one. It talks about the factors and standards involved in your type of situation.

    You will likely need to go to court and have the judge decide.

      Thankful for all the helpful information! Yes, I think the lawyer was incompetent. Unfortunately, we have hardly any money to spend on a new lawyer, but we are trying to get some together. I will look up the Addison case, thank you. The lawyer said yesterday she is going to get my husband in to see the Attorney to the US Trustee next week so my husband will have a meeting. We'll see what happens.
