    Couple Questions

    Hi everyone, great site! I have a couple questions that I have not been able to find the answer to. Here goes:

    1. If you loose your job, do they still go back 6 months to get the avaerage $ for the Means test? Or do they take the loss of the job for what it is and go from there?

    2. Does unemployment pay counts towards the Means test or is it not included since it is not guaranteed income past the allowed time given?

    1. If you lose your job, they DO go back 6 months to get the average $ for the Means test. However, for the schedule I, you enter your current income.

    2. From what I understand, it depends on what district you file in whether unemployment counts towards the Means test or not.

    I'm in the same boat as you. I was laid off, and will be filing soon. I was lucky that I am under the means test based off of my last 6 months income, though.

      toughtimes, you probably mean that unemployment is guaranteed to end at a specific point in time. if you know of any job with guaranteed income forever, please let me know! tdawg is right, it depends on district. you can research it or ask your lawyer.

      they do look back 6 months, but the determination of left-over income that could be used for a chap 13, they do look at current income-expenses, so even if you appear to be over the median because of the part-time job, you may still qualify for a ch7.
