How long before they ask for my car?

Its been about 2 weeks since the meeting of the creditors.
I have not yet recieved a discharge.

I am not reafirming my vehicle. The balance was around $45k on it.
It is thru GMAC. They did not show at the meeting and they have not contacted me to turn my vehicle over.

How long before this usually happens?

I haven't paid a payment in about 7 months.
payments are $1k each.

My last payment for my car was May, I filed in June, I was discharged on 9/21 and they came knocking on my door to take it on 10/23.

I stop my car payments on 3-10-09,they came for the car on 11-18-09.

During active BK, there is a automatic stay and GMAC will have to petition the court for permission to come and take it.

However, if you do not intend to keep the car, I would just wait until they call and arrange to return it on your terms. This would prevent the untimely repossession at the grocery store or the like. If you return it to them, you can be sure your belongings are removed and the gas tank is empty.

wow a grand a month what kind of car are you driving? Mercedes SLR?

This is good news. We can't make this months SUV payment, but looks as though we maybe able to keep it for awhile longer. We do not plan on keeping it. (give us time to save a few bucks to buy a car outright). We are seeing an attorney tomorrow (12/02/09) for our consultation, but we already know what we have to do, I just hope we are able to File BK.
