    Wells Fargo/TempurPedic and 341 Today

    My fiance is off at here 341 right now... hopefully all is going well. While she is gone today's mail came and there is a packet here from Wells Fargo. She had financed a purchase of her tempurpedic mattress almost 2 years ago. They sent her a reaffirmation agreement. It states that the loan is secured.

    She of course doesn't have any recollection of them telling her this in all the paperwork. She thinks it was all done online.

    Is it likely that it is secured by the mattress, or is that just a tactic to try to get her to sign if she doesn't want to have to replace it.

    Okay myself I would never trust WF the stories I could tell would raise hairs on your back, but bore you to death too.. lol I sign nothing without an attorney reviewing it... And let them take the mattress... I can't begin to tell you how much it is worth and in many states I think there is a law against selling just a mattress, but you can toss it in with the bed and boxsprings. So, is it just hte mattress? And how many people are standing in line wanting a used mattress? I know this is an expensive one, but look at craigslist and see what they are asking for used one... or try to garage sale it once. That will give you an idea of what WF will get if they repo it.. then they have to pay someone to sell it for them. Seriously, talk to an attorney.

      you could probably ignore them. the headache they will have trying to repo your mattress from within your home (they can't get in unless you let them in!) won't be worth it to them.

        One thing that I would NEVER buy used is a mattress.

        I'd call their bluff, but that's just my opinion.

          One of the cards i'm defaulting on is a Citifinancial Retailer card for a mattress retailer. So far just a lot of calls from Citi, and now it's refered out to a Ca. No one has called to pick up the mattress, and i doubt they will. i think WF is bluffing, just trying to get you to Reaffirm.

            Ignore the reaffirm papers from Wells Fargo. There is no way they will repo a 2 year old used bed!

            01/11/2010 - DISCHARGED & CLOSED

              The only people who really follow through on this is Nebraska Furniture Mart (A Warren Buffett Company), and they are famous for it. They WILL come get their two year old mattress (and anything else they financed) if you don't pay for it. They don't care how little they get for it or how much it costs or if the kid has peed on it a dozen times: If you don't pay them for it, they're coming to get it. If they can't sell it, they'll incinerate it. But YOU don't get to keep it.
              Pay no attention to anything I post. I graduated last in my class from a fly-by-night law school that no longer exists; I never studied or went to class; and I only post on internet forums when I'm too drunk to crawl away from the computer.

                  Hehe, let em come get it.

                  Will cost em $200 to pick up a mattress.

                  Then they will pay $100 for the dump fee.

                  And another $150 to get it there.

                  LOL this is one of the best posts ever. Thank you it brightened my day, and I am not poking fun at you, but at WF. Idiots, they are, truly.

                    DON'T SIGN IT!

                    We had an actual loan out through American General for Broyhill furniture, which we purchased 90 days before filing. They sent us a reaffirmation agreement for the total amount due ($1500) We said NO WAY! They never came to get it.

                    We also purchased a mattress via GEMB 90 days prior and we never heard boo.

                    They can't come to your house to get it unless they have a warrant. After all is said and done, it costs them more to go through the hoops than your old mattress is worth.

                      We have a mattress bought with our JCP card (GEMB) 2 yrs ago--we still owe a couple hundred on it. Hopefully, GEMB doesn't want our mattress back either.
