    Does the trustee go over spending records?

    Just curious because hubby and I have purchased some much needed clothes, and started buying a few small Christmas presents as we see them on sale. I have been using my check card but then I am thinking that it may look like we have extra money to pay for our CC's? My husband has not bought new clothes for himself in about 5 years and lost a lot of weight and really needed them, and I really would like to buy a few things for our family that does not come from a thrift store or dollar store for once.

    Also, what about things like eating out? My husband has been going to cheap fast food places for lunch instead of taking one just because he is burned out on homemade lunch. Can the trustee question that expense because it is a new one and is coming off the check card?

      My lawyer said to live as normal within your "new" cash means (check card OK). Just don't go spending it on a trip to Jamaica, I think a dinner out now and then is just fine.

        My attorney told me as long as what you spend is from your paycheck deposited into your checking account, you are fine.

        Meaning no deposits into my checking account that are cash, only my paychecks are to go in. Live life as I would after my BK.

        Today was the first payday in months I had cash left over, I am still at a loss as to what to do with this....so I rat holed it.

          Is it a bad thing if I did put some cash in? My MIL gave us some money to purchase some things for her because she does not drive. I really hate to carry cash so I deposited $300 into my account and used my check card to pay for the items at a few stores. We are not going to file for about 2 more weeks.

          I have been wanting to put some cash away for emergencies, if I take checks that are given to me for holidays (my MIL just gives checks for Xmas and Bdays) and cash them at her bank do I need to disclose that I cashed it?

            It can be, the TT could ask, where did you get the money for this deposit? Large deposits could make him start to search for hidden assets the TT may think you have.

              The money is a gift from my MIL for birthdays, my daughters school lunches that she wants to pay for etc. It usually is $100 or less but this time the $300 was to go buy some things for her. My MIL's bank is closer so a lot of time so if she gives me a check I just go to hers and cash the check and use it for our spending money.

              A couple days after I put the cash in I took the amount of our house payment out in cash and took it my credit union, if it is questioned should I say that she gave it to me for part of our house payment or just tell them that it was for her shopping?

                Just be honest and tell them what it was for. Just hold on to your receipts and you'll be fine.
