    Discover Card & Chapter 7

    Hi,

    I am two weeks late for my Discover card and am getting those 614 area code numbers 5-6 times per day. I am planning on filing BK in Feb if I am still out of work come this Jan. I do own a truck outright and in FLA if they use full retail value, I will probably show a $10,000 asset and the $1000 vehicle exemption doesn't go far. Will Discover try to sue me if I do not answer them, and can they get a judgement, and execute it against my truck by Feb?? We are looking at 3 months. THe other credit cards I am just starting to fall behind and will behind on all come Dec 1st which will be my first time I ever defaulted on any account.

      Jessica-I too had never been behind on my payments until we decided to file. It was then that we stopped paying and by the time we filed, we were 4 months behind on our CC payments. We were never sued. One thing I did do, was sign up for Google Voice as per the advice of another member here on BK Forum. I changed all my account info on my CC's to that number and all calls stopped coming to my home. That is really all that they do. Call and send letters. Once we had decided what attorney we wanted to use, she said we could let them know we were filing and give them her name and number. The calls stopped almost immediately and believe it or not, the people on the other end of the line were actual very kind. I was a bit shocked. Anyway, I would say, if you are going to file, stop paying now. Have a blessed Thanksgiving and remember that there is a light at the end of the tunnel.

        4 months behind on CC payments... Wow, I was thinking they would start paper to garnish after 2. My situation is I need my tax return to file. I have to last untill Feb or March, and that will be 4-5 months of not paying CCs. God I hope I can make it that long.. I was told there was a process to garnish and sue, and it alone take time to do that. Keeping my fingers crossed!

          For us, it took awhile, but I also let them know that we were filing for BK.
