My fiance and I both filed seperatly. My 341 is tomorrow and hers is Monday.
Have a couple questions:
1 - for mine I listed a debt to the Illinois Tollway in mine. I know that these are supposedly not discharged. I expected them to file a claim or something. So far nothing. If they don't file a claim or an objections, does it get discharged?
2 - my fiance has a townhouse with her ex that has been on the market for ages. She is planning on reaffirming, but has only gotten paperwork for her home equity line... not the primary mortgage. Can they choose not to?
3 - my fiance also has a debt to American General. They filed a claim wanting to switch it to a secured loan. I'm guessing they'll have someone at the 341 or have sent reaffirmation paperwork to the trustee for her to sign. If they do not, what happens? If they do, and she refuses to sign the only property listed on the security agreement is a Television that based on the model they have listed she never owned. I guess that whomever she talked to over the phone filled out the security portion themselves. She did sign it... knowing her she probably did not read it carefully enough to notice. Is that a problem? Can she simply refuse and when they ask for the tv back say she no longer has the XXXX brand.
