    Just filed in GA, couple of questions

    Hi there,
    We just filed (our attorney did) but I wanted to get a few other answers, especially from those in the Georgia or middle GA area.

    I am surrendering my car. Can it be repo'd before the 341? When does the car need to be turned in?

    We are currently 3 months late on our Countrywide/BOA home. We owe more than it is worth. We are surrendering it. How long do you think we will be able to stay rent-free in the home considering our state/area?

    I filed in the North Georgia. Once you have filed they can't come get your car unless they file for a stay of the relief. They won't. In addition, unless the creditor shows up at your 341 and asks for the keys you don't turn it in. You keep driving it and enjoying it. You leave nothing in the vehicle and minimal gasoline in the tank. One morning it won't be there.

    My van is still sitting in the driveway. I drive it every once in a while and it is great to have a spare vehicle. They sure tried hard to repossess it before I filed but once I filed Ford seemed to forget I existed.

      Carl you may want to read this manual, it gave me lots of insight as to what can and can't happen.

        Regarding Bofa Former countrywide I paid last time in april, while still in active BK. Auction date is set for Dec 1st. However no promises the deed will be done then or not. Still in the house as of typing this.

        I had 2 rentals as well. One is over and done with. Former wamu now Chase loan. Other rental is Citi. Auction date been set 4 times. 1st three never stuck. Resident, son of good friend, lives there rent free atm. Will see if Dec 1st sticks on that one as well.

          We are just trying to skate by as long as possible in this place since we're moving to Florida for a new job in June. I doubt we'll be able to hold on that long, but as long as possible would be great. We'd even be willing to start paying again as long as we could walk away.

            I live in Georgia Middle District, my mortgage isn't with BOA it is with Wells Fargo(more aggressive on F.C. than BOA) but my last mtg payment was in June. I filed Ch7 in July, Wells filed petition to lift the stay in Oct. it's now Nov. and still no notice of default. So it's already been 5 months with not paying and remember in GA. they have to list the foreclosure in the paper for 4 weeks then they only auction them off on the first Tues of each month.So I figure I'll be here till at least Feb 2010 which would be 8 months so you may be able to stay there until June.
