just an update and need an input if you all have some....my credit cards are all in collections now...i am trying to wait before filing for BK. Its been more than a year now since I did my last cash advance. No lawsuit from cr cards but the LAWSUIT came from the house that we previously had that we try to short sale but went into foreclosure. Low and behold they wanted us to pay for the deficiency. The second lien that was a HELOC. Where on earth will I get the money to pay them? I am still saving for my atty fee for BK. Is it true that HELOC is not covered by anti-deficiency law in az? BOA refinanced our previous 2nd mortgage, some money went to upgrade the house and the rest we used to supplement to pay the 1st lien since we are short on our monthly budget. I was reading that if they win the lawsuit they can put a lien on our current home. Any input is appreciated. Thanks

follow up on my previous post...we have 2 homes that was foreclosed...both have heloc as the 2nd lien...but the other one i am worried about since i used some equity on that to pay my cr card before but not all....will that be an issue for objection if ever i file for BK? Now I am thinking of ch 13 instead of ch 7 instead eventhough we are way below the means test. I guess the 1st lien did not give the 2nd anything that's why they are going after us now.

I don't know the answers to your questions but wanted to suggest that you copy and paste your recents posts to a new post and start a new thread. Your lastest questions are now buried amongst an old thread. You're more likely to get reponse I think.
