    What happens if there is a balance still?

    What happens if there is a balance on the CC that may have come from fees after the lawyer prepares the BK but before it is filed? My lawyer is working on our case but if they are done with the drafts and has one amount they are filing on and a fee comes out they do not know about do we pay that? Also do we have to pay the difference before the case is discharged?

    So long as you don't USE the card after filing then there is no issue. The balance due only matters if you have assets and even then it's between the TT and the creditors. BK7 discharges all debt, amount really does not matter. If they are notified it's done.

    Even if you do use the card after filing but before they close it odds are if it's small they will probably just ignore it. Would cost to much to litigate it. Not that I'd recommend trying it.

      Thanks for the reply, I haven't used them since August and some even longer. I keep getting the bills and they are tacking on about $100 a month fees per card and I just wanted to make sure I wasn't going to be paying the difference.

        I just received my draft petition from my attorney and that is one of the questions I have written down to ask him when we meet. I gave him the statements I had at the time. Now my statements show higher balances because of late fees and increased interest rates. I want to be sure the entire amount is taken care of in BK...
