    well we did it!

    hi...
    this board has been so very helpful....and well, yesterday we went and retained a BK lawyer.....I was so scared I .....my head felt like it was going to explode!!!!
    we went into his office and told him our reasons and how we got into this mess, (my huband retired and expected a GOOD part time job, thats when the economy died) and so did our plans!
    The lawyer was very straight forward especially about my gambling. I expected that..and that was ok with me.. We went in asking about a 13 and he said.nope a 7........then I mentioned our leased car and overmilage, I told him I thought we could handle that cost...he said.......its going into your Ch7.
    So finally we gave him the retainer and he said forward all calls to me....I hope that works....We will be formaling filing in April......he said pay no CC at all.
    I want to mention this lawyer is one of the Biggest in NE Ohio, his rating at the BBB is A+++ ... my sister recommended him I trust her

    When we left...it was a feeling of relief more than happiness... I know this is the first baby step for us.BUT it does feel a lot less stressful already, there looks like a light at the end of this tunnel.

    Lastly I wanted to ask .......as mentioned we ONLY retained him, he told us to forward all calls to him..we have NO case number yet, and from what i have read here some collectors refuse to deal with the lawyer unless there is a case number........is that correct? Because...last month on one bill, I paid $100 instead of the required $125...and that company has called me 4 times in ONE day.......so I was hoping referring him to them might slow the calls that will be coming down.....

    Again thanks you all .you gave me the GUTs to go ahead and hopefully become a member in the 60 day club...YOU GUYS ROCK!!!!!!!!!!

      Congratulations. Even if you haven't officially filed yet and don't have a case number, you can still refer them to your atty and he will get them off your back. Since you've retained his services, it means you will most probably file and that will be enough to make them leave you alone (at least that was my experience). Good luck and enjoy the quiet because your phone will stop ringing.

        We started out years ago with intent on a 13. Our lawyer told us the same. The calls did stop. 'Hub

            Yeah! Congrats on getting the BK ball rolling....

            I retained my 1st attorney (long story) and was unable to pay his fees in full for a year, I was able to refer all calls to his office. I very rarely got credit calls EXCEPT when the original debt switched hands/sold off/transferred, then I would just give the info to the new CA and that would be it....

            May 28th - Filed for Ch 7 (FINALLY!)
            9/11/09 - DISCHARGED!!!!
