    Trustee Initial Report Has Been Filed

    There is no other info available yet but I assume its because the TT told me at the341 that she wanted my tax refund? I am fine with that but wanted to clarify that I should still get discharged in 60 days? And my case will stay open until she gets my refund? I have no other assets.

    Yes more than likely you are fine. You would find out far before the 60 days if not. Depending on the amount of refund, she may take it or may not. If she were to take it, you would be extended 30 more days as an asset case. If it is small, she may not bother.

      If the trustee filed an initial report and you cannot see it, it means that the trustee is considering making you an asset case. In your case it sounds like the trustee is considering taking your tax return. If that is your only asset, then you will be discharged in 60 days, and closed when you turn over your tax return.

        My tax return should be about 2 to 3 k this year much smaller than previos years?

          That is a hefty amount. I was over my exempt $5400 and got an extra 30 days to note all my Matrix creditors that I was an asset. So, not to say B2S is off, but it would be my guess it would be a close call to not go 90 days. None-the-less, it is worth it, believe me. 'Hub

            I notice a lot of people mentioning tax returns and having the trustee take it. Is everyone discussing the 2008 return that was filed this year or the 2009 return that will be filed next year?

              My trustee filed a turnover order for my vehicles and asked at my 341 for my lawyer to submit my offer for buy back. Last day for objections is Nov 17 and hearing on Dec 2 for turnover motion. Called my lawyer and he stated that was just a paper trail. If we can't come to a buy back agreement, then I would just surrender to trustee and not have to go to hearing?
