A short recap of my problem. We initially filed a CH 7 in December of 2006. At that time we signed a reaffirmation agreement with HSBC on my Jeep. Then in 2007 the UST made us convert to a 13. Then in April of this year we converted back to a Ch 7 and were discharged.
We've been wanting to surrender the Jeep but HSBC said we couldn't b/c the reaffirmation was still legally binding. My lawyer sent them a letter explaining to them that once we converted to a 13 that voided the agreement and since they didn't send a new one for us to sign once we were back in a 7 that we aren't legally liable.
After 2 long tense weeks they finally called today and said that MY LAWYER IS RIGHT! We aren't legally liable. We've already got financing and will be buying a gently used much cheaper minivan this week and in the meantime I quit paying my Jeep note. It was $600 a month. I put the money in the savings account so I now have Christmas money! I'm so excited! THe only problem now is they want to repo on Thursday and dh won't be off to sign papers on the new van until Saturday.
But that was our last hurdle and I'm so glad we are finallly DONE!
