    When you get discharged, how do you know what wasn't??

    My petition show things I would like discharged, after the discharge comes, if anything CANNOT be discharged will I be notified?? Do the discharge papers show what or what does not get discharged?

    The attorney put student loans on and said sometimes they go through. I KNOW, they probably won't and if they don't I'm just wondering what happens

    You'll get a letter signed by the bk judge overseeing your case. The verbiage may differ by district but, it'll say all debts eligible for discharge have been discharged and refer you to the section of the bk code that deals with exceptions to disharge. Unless you have some of that in your petition, the debts are discharged.



    As to SL's. Unless you filed a separate AP to deal with them and got a judges ruling that they are eligible for discharge, they survived. You need to make arrangements to start paying them.

      I had taxes that were non-dischargeable and my atty. told me up front my chapter 7 wouldn't wipe them out but I had other debts from business that I needed to discharge so my BK benefited me in one way but not for the taxes.

      Find out from your atty if you still aren't sure because my discharge paperwork didn't separate the taxes out but I knew up front they were non-dischargeable and I'm making arrangements to settle them now. If your atty says they were not discharged, contact them to make arrangements because they will start sending you notices soon anyway.

        No one at the court is going to give you a list. A debt is not discharge if..
        1. The debt is excepted from discharge. Section 523 of the BK code
        2. A creditor filed an objection to discharge and won (you would know if this happened).

        Much in bankruptcy happens automatically. For example, section 523(a)(8) of the code says that student loans cannot be discharge, thus, if you have a student loan, it is not discharged. That is all there is to it. So, if you listed a student loan in your petition (which you are required to do regardless of the discharge status), that debt is not discharged by your bankruptcy; but no one is going to tell you specifically that it wasn't discharged.
