    In 2 weeks I Should Be Dischargd

    In 2 weeks I should be discharged, on November 15 It'll be 60 days from my 341 and nothing has been said about objections.

    I am so happy to be out of debt even though it wasn't that much, but I haven't paid any of my cards in 2 years and I wouldn't know who to have paid.

    I do got one question though I filed caused I was sued by fifth third bank, and they had a judgement against me, which was included in the bankruptcy.

    Will the judgement just disappear or do I send a copy of the discharge to the courts?

    It's my understanding a motion will have to be filed with the court who passed down the judgment to vacate said judgment. Bk will prevent any further action to collect on the judgment but will not remove it by itself. The motion has to be filed with the court. If you have an attorney ask him to submit the motion for you. Most will charge a modest fee in addition to regular BK fee's to do this.

      What happends if I dont? I don't have any more money to pay for any more motions or anything.

        Well the judgment could stay on your credit report then and if the judgment gets sold or whatnot you could find Zombie collectors trying to come after you. They can't do anything, but the could prove annoying.

          doesnt the bankruptcy discharge take care of the judgement?

            Like I said it will stop anyone legally being able to contact you in an effort to collect on the debt. However it does not automatically vacate the judgment.

              so legally even if I don't vacate they can't touch me right is what I should ask?

                Yes, but it can stay on your CR and harm your credit rebuilding efforts, if any.

                    Congrats to you. I'm just over a week away myself. I will have two judgements to remove, I plan on calling the courts myself and filing the paperwork. It will take minimal effort, then you can clear them off your credit report! The slate is clean!
