Just a comment on taxable gambling winnings. I believe you can offset winnings by gambling losses and in your case, you shouldn't have a problem proving your case if required. Yes, I am aware that gambling losses can be offset against gambling winnings (had to do it for a 'few' years), however... the bad part is that the 'AIG' ( Adjusted Gross Income'), which is the income PRIOR TO TAKING GAMBLING DEDUCTIONS, and is the amount that is used to establish how much ( if any) of the Social Security Income is subject to taxation.
In my case spouses gambling 'winnings' bring Social Security Income up to max amount of possible taxation, while in comparison without those 'winnings' NONE of our Social Security income would be subject to taxation...therefore the impact to the tax burden is drastic...
Personally I am surprised that not more of an issue is being made out of this 'add on tax' imposed on Social Security income. With as many seniors gambling...one would think... or...
at least, one would think the casinos would lobby to have the extra taxation on SS eliminated...after all, would directly effect THEIR bottom line a huge boost.... get it ? more money into the senior gambling hands... more money to casinos....
Ghee...maybe I could get a job getting hired as a lobbyist by the casinos..... to be able to repay my debt...???

I think that I've read there is issues with money lost due to gambling. I've been trying to understand everything and I'm new in this "bankruptcy" way of thinking. But I think I read that you can be ordered to have to make payments on the money that YOU PERSONALLY gambled away. The fact that your spouse is guilty of that makes this a little more challenging.
WE also have a big fear of balance transfers that were made on our cards. We have $120K in credit card debt that we haven't made payments since Feb 09. We tried working through the credit issues by signing with CMS/Brad Daley and reassigning our debt to Brad. It's all very complicated, but we tried to change the terms on our credit cards, just as they had changed the terms on us. We continued to make payments on our cards until the interest rates jumped and we gave up. CMS may very well be the reason that I haven't been taken to court. Then again, it could just be our "luck". We haven't quit CMS, we are just sick of not getting ahead.
Anyway, I'm not sure if 90 days will matter with regard to our balance transfers that were made less then 2 months prior to stopping payments. We are at the end of our rope at that point and should NOT have made the decision to take more money out on our cards. But it was that or lose a house...so we did it. Now, I may have to pay for that decision. You may have to pay for the same decisions you made.
A good attorney is the ONLY one with real answers for us. I finally have my appointment set for Nov 10th. I can hardly wait. I will finally be able to come clean with all of this and hopefully take the first steps and living my life again.
