Heard back from my attorney today. I had faxed him an old title and insurance policy that he in turn sent to the financing bank of the motorcycle. He told me to just wait because the next move is theirs and we want to see what they have to say. Hopefully it will be a positive outcome for me. Thanks everyone for your comments and support.

When I got home from work today there was a subpoena wanting for me and guess who it was from, That's right the motorcycle attorney requesting my presence in court in January 06. If I agree to reaffirm this agreement can I request a lower monthly payment? What would you guys do if you were between a rock and a hard place? I just want to pay them and get them off my back.
If I reaffirm this bike and my automobile do you think the trustee would allow it. Up to what amount can you claim exemptions?

Don't panic yet. A subpoena is just for them to ask you questions under oath. One way to look at it is that it might be very good news. If they had their mind made up and didn't want to hear your story, they would have just sued or sought a judgement. This "could" be a very positive sign. Art

They already have a judgement against me that is why I am concerned. All they will probably do is have it reinstated. I'm concerned because this court date is after my 341 meeting. My 341 is 12/20/05 and this court date is 1/19/06. I'm worried and maybe I should just agree to pay for the motorcycle. The person that wrecked the bike said they would agree to fill out a paper stating that I did get the bike for them and that they did wreck it. Keep the faith. Did you check with 722 Redemption yet? Didn't realize that you already had a judgement against you. Wonder what the statute of limitations is on that?
Keep us posted!!!! I am leaning towards the fact that this was a while ago, maybe that is good. Looks to me like if they thought it was fraud, they would have persued this a lot sooner. Can't tell you not to worry, but you already know the best and worse case scenerios and seem prepared for both. I think time makes us all wiser. Too bad you can't find him and shove the rest of the motorcylce parts where the stand the least likely chance to fit.I'll be watching, you may never know when or how, but I'll be there. I am there now....

I couldn't agree with you more about the parts. I would certainly like to shove a square peg in a round hole. I can't do redemption my attorney said I have to have the motorcycle to redeem it. I feel really bad when I feel the need to impart words of wisdom that I know no onw wants to hear, but I was just throw out some options there. My hope for your case is the length of time that they had have the judgement out against you vs now. I don't think they can prove fraud, I would think that should have already been done, if they thought that. We all sometimes make poor decisions, it is a learning experience. You can't get up with him, they probably can't either. I am sure they have written this off long time ago, surprised that they are spending the time and money to objct. Please keep us informed this is how we learn.I'll be watching, you may never know when or how, but I'll be there. I am there now....
