    The Chap 7 BK process, a diary by me....

    i wanted to share my thoughts, which i will do as bullet points. Just a little background, i was agonizing with filing for atleast a YEAR, and i mean agonizing..

    * Think about filing for a year - credit score dropping, collectors calling, 2.2 million in non consumer debt, 1.3 million in assets, income $180,000 per year

    * March 2009 -Saw a VERY GOOD attorney

    * April 2009- Bought NILO book "how to file chap 7" Highly recommend just so you know the process - worth the investment

    Aug 30 - FILED Chap 7- No Asset- cried my eyes out in front of attorney

    Oct 2 - 341 held- was VERY nervous, went great (no creditors showed)

    Oct 3- Case turned to ASSET case, trustee hires HIMSELF as the trustee's attorney

    Objections due by 12/2/09

    Summary: Friends, if you have debt you cannot overcome, file! What a relief this has been, and the process seems streamlined. Do not be afraid, be only afraid of the consequences of NOT filing. I thought filing was the end of the world.....just the opposite! I am renergized, optimistic, and renewed. If this thing dragged out for 10 years, it would be better than the shit i was going thru before BK. The one element that i suggest you have, if you can afford. ATTORNEY! A BK ATTORNEY! One who does all chapters, has experience, knows the trustees, and is not a churn mill. One that offers replys to your questions fast, and one that is personally with you every step of the way, including the 341. Just FYI, i have spend almost $8,000 so far on my attorney, and it's probably no over, but if you can afford, it is the best investment you can make. Reply with any questions you may have!

    We hired a BK firm that only deals with BK. Our thought was if you have a heart problem you don't go to a family physician but to a specialist - heart specialist - so we went to someone that knew the BK process and all the treustees and judges.

    09/25/09 -- Pacer States "No Assets"
    11/25/09 --DISCHARGED!!!!!!!!!

        I have a qestion. We have our 341 in a few weeks. How does a no asset ch 7 case go to an asset case?

          You have assets that are above the exemption level for your state.
          For most, it's usually a portion of a tax refund that can't be exempted.
