Name on DL doesn't match SS Card...

Here's a good one...I just realized this. We are a few weeks away from filing, and I just remembered that the first name on my SS card doesn't match the first name on my driver's license.

Don't ask me how the DMV did this one. They put "Joey" on my DL, while my SS card says "Joseph". *sigh* Middle and last name are correct.

It's never been a problem in the past, but I'm thinking ahead to the 341, and wondering if this will be an issue? The papers will match my SS card, but my ID will have my more common first name...

If it will be a problem, should I go get it changed at the DMV now? I'm afraid if I do that, I will only have the temporary license, which I'm not sure would work. Only other thing I have that has my picture on it is my ID badge for work.

    Any thoughts?

My husband technically has two last names(hispanic heritage thing) but on his DL he doesn't use it. The lawyer put on the paperwork both names and just listed one as his alias. He said it wouldn't be a problem.

You said that you are a few weeks from filing, if you go and change your name now, you should have your licese within 5 business days (I think it's common for DMVs). Even if you have a temporary license, it still should work, what if your's was stolen and you had to replace -- also, your passport and a number of other things should work.

However, I saw many lawyer mentioning in the petition that names are different on ID vs. SSN card and it was fine by the trustee. My wife had different middle names on the DL and SSN card (we are both immigrants and her's was converted incorrectly at the DL) and it wasn't a problem. The difference was quite significant, something that would make it a first and a last name in the home country

The wheels at the California DMV move pretty slowly. They say up to 60 days to receive the new license. I'm not sure if the temporary is good enough for photo ID, they usually just staple a paper copy of the picture they take to the temporary license...

I kind of had a feeling that I am not giving you a good advise, for some reason, I assumed Washington state and went with how things work in WA. But as I said, I think if your attorney mentions it on the petition, it should be just fine.

Nah, not bad advice. I was thinking the same thing, until I looked at the DMV website! =)

I'm going to go ahead and go with the "put it on the paperwork and hope it works" thing. I don't want to cause problems by possibly having a temporary ID only, when they would have taken my (slightly incorrect) DL in the first place.

Thanks everyone, I feel much better about it now. One less thing to worry about!

One lady at our 341, a pro se filer, had two different names on her DL and SS cards. The SS was correct, but the surname on the DL was incorrect because she had divorced, and resumed using her maiden name, but had not changed the name on the DL. The trustee continued her 341 until the next month. She had several problems that had to be worked out in the meantime, and that was one of them.

For our part, 'Hub and I are married, but each use our own surnames. Our DLs and SS cards showed our names. But we had to bring a copy of our marriage license with us to the 341.

For 'Joey's' part, I don't think the 'nickname' on the DL will be that big a deal. Our trustee seemed more interested in the surnames.

As already mentioned, there is a location on your petition (Official Form 1) that asks you to list all known aliases used in the prior 8 years or so. I would bring my SS Card, Driver's License and birth certificate to the 341 Meeting. That should be sufficient if the Form 1 has the alias.

Yeah, I don't think you want to take a temp. ID with a stapled on picture to security in the courthouse.

Good luck and I hope the whole process goes smoothly for you!
