    >Lucky for you the rules of this wonderful country allowed you to welsh on that original deal and get the debt forgiven. Now they are using the rules to their advantage to try and get something back in the deal. Isn't this game wonderful?

    Kind of harsh calling OP a welsher when you've filed BK yourself, don't you think?

      Bankruptcy is seen as a new start. Even in Biblical times, every 7 years people were to clean their ledgers and allow forgiveness of debt to their debtors.

      The Op in this case has not refused to give up the so called secured furniture. They stated to "come and get it, it will be on the sidewalk". The Creditor had the whole time to make proper arraignments. It is wise to keep it safely in their house as it would be a micro second on the sidewalk before it would be carted off by the public.

            Pookieny, you are correct. I am the first to admit that I did not live up to the contracts and promises that I made. However, the rules of the game allowed me to do just that. The people that granted me credit did so understanding there was a risk that I would not pay them back but hoping I would. Life is a big game and well, sometimes we have to use the rules to our advantage.

            Now, in the OP's case the creditor is using the rules in his/her favor to attempt to get something back out of the bad bet that they made. Truthfully, did the creditor lose? Probably not... With the interest rate, payments already made and the like they didn't do too badly.

            If I was in the OP's situation I would clearly tell them that they have two options, (1) Schedule a pickup date/time. (2) Write it off and move on. They are unable to attempt to collect the debt but are able to pick up the collateral. Explain that you will are 100% willing to hand it over.

              I would not play their game. Just ignore them and they will go away. JMO.

                How do you know the creditor is within the rules? IMO they are in violation of the discharge. If you read both OP they offered to give the furniture back. The creditor refused stating that they signed a statement when they purchased the furniture stating they would have to pay for it no matter what. It sure sounds like they are trying to collect the debt, which would be in violation of their discharge. I do not believe this creditor is within the rules at all. It may be worthwhile to call one of those contingency lawyers and see what comes of it.

                  I think it's a matter of who blinks first loses. The creditor extended secured credit to the OP. They have a right to recover their assets. They won't but they sure want to scare the poor woman into paying them something for them.
                  Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick
