    VERY interesting 341 and what can happen now?

    First, I want to say hello to all of you! I have been reading awhile, but just decided to join.

    So, I was so scared leading up to the 341. It was almost our turn when a security guard came in and told us to evacuate. There was a gas leak. So after over an hour of waiting, we finally get to go continue. Our lawyer told us to be prepared because of our income. My husband makes a nice income and I stay at home with the kids. He knew this trustee and knew what to expect. Well, after all that waiting the trustee blew right through us!!
    The only thing he asked was what we did with our tax refund last year. We got back $5500. Paid 3 house payments and have proof. The end!

    So, what can happen now? We have had a furniture place ask us to pay back partial and also Best Buy. Other than the creditors, what else can be questioned?

    I'm kind of curious about Best Buy showing up. Seems they have been rather active lately. What exactly did they want?

      We owe about 8k. I would say 3k is interest. The only big stuff is a Washer and Dryer that cost about 2200 4 years ago and a 400 Dyson bought a year ago. They want 4800 I said no way. They can come get it. All the other stuff is video games, movies, cd's, x-mas gift, small stuff that the attorney said the can't come get. He said we can make an offer. I said 800 or they can come get it. This was 2 days ago so have not heard anything yet.

        Oh, and reading here it looks like we are going to lose our tax return next year. We are keeping the house and I was hoping to make extra payments again.

          You don't want to do any side deals like Best Buy and the furniture place want. We were told emphatically by our attorney that do make any kind of side deals like this while in BK, will cause our case to be dismissed.

            Wouldn't the furniture place and Best Buy have been included in the discharged debt portion of the BK?

            PS: glad the building emergency did not delay your 341

              We were not told that. We did the furniture. It is our living room set and daughters furniture. If we didn't she would not have anything.

                Mistake! They're bluffing. They won't come and get your furniture or your washer and dryer.

                  Used furniture and washer/dryer are worth so little, no they will not come get them but if you decide to pay do a reaffirm NO side deals, please! A friend of mine nearly had her BK thrown out due to a small side deal.

                    The furniture companies lawyer actually showed up at the 341, so our lawyer said they were serious, Best Buy, not so much.

                      I doubt we will have a refund this year as hubby is working on commission and not making great money, but he does not pay in to taxes either. And I don't think the unemployment paid all the taxes either. In Dec. I will take our pre-taxes in for review and see if maybe we can move any refund into a retirement plan for him. Being on commission he does not have one, so we can maybe cut our tax burden that way. But I really don't think it is a problem since we will owe SS, fed and state.. I am betting we will be on a payment plan instead of a refund.

                        Does anyone have any ideas why Best Buy has been so active lately? It might be all smoke and mirrors but I've heard more than a couple of stories where BB demanded payment and otherwise threatened to pick up the merchandise. Seems like their collection practices in BK might be more agressive but at the end of the day they really don't want your used stuff. That stuff is not worth anything to them so I'd call their bluff and stay away from side deals.

                          I second the motion to call their bluff (including the furniture store). You can play all of your cards down.
