    discharged and closed what is the difference?

    i was discharge in dec 2008 but i don't know if my case is closed. how can i find this out? i had an attorney help me and i've asked her but her reply was that it was discharged & she believe it was closed. she said she had closed my file and it's in storage. i need something more definite.

    also, from reading this forum i understand that a case can be audited even after being discharged. is there a statue of limitation on when a case can be audited? i've asked my attorney & she told me that it could always be audited. so, even after being discharged there's always a chance of being audited at anytime?

    Call the bk court clerk and ask for your case manager and ask the status.
    Once discharged and closed, they're done unless, some evidence of fraud surfaces later.

      Closing a BK is basically an administrative event, it is over for the debtor when the BK is discharged. After the discharge, the only way it is going to become a legal issue again is if there is evidence of fraud.

      There is a sticky about discharge VS. closing on the forum-I would read that, and not even bother with seeing if the BK is closed (it no doubt is at this point), because that is essentially meaningless to you.

      Last but not least, according to a federal courts website I read one in 2,500 BK's are currently ever chosen for audits. It was one in 250, but budget cuts made them reduce the number they audited. Also, an audit is a non-event pretty much unless you have committed fraud of some kind.
