Okay, is this ODD or not?

I filed Ch7 pro se and according to PACER, everything is in order. My 341 is scheduled for 10/27. A couple of days ago, I received another mailing from the court stating that my discharge hearing was set for 01/20/2010 and in bold, capital letters it said, YOU MUST ATTEND TO OBTAIN YOUR DISCHARGE.

From what I've read here and elsewhere the debtor is usually not required to attend the discharge hearing, especially for a no-asset Ch7 case. Is there anything unusual I should be looking out for?

Ask the trustee when you have your 341 meeting. Since you are representing yourself, you can ask these types of questions. If you had an attorney, then you would be directed to talk to him/her.

Thanks Angelina. I'll do that. I'm not all that worried about it, though it did seem odd. They may be pretty casual in this area with BK filings. When I filed my petition I included my most recent tax return and 60 days of pay stubs. They sent back the tax return and the pay stubs with a letter saying that they weren't required. I'll take them to the 341 just to be sure, however.

Do not volunteer any information when asking the question. I can't tell you how many times I've had clients who were fully prepped (by me personally) and they still volunteered information that sunk them.

Check out this link on my site for some more information about your 341 meeting (just a note, it isn't done yet).

          Hello JK:

Welcome to the forum. Your advice to volunteer nothing is excellent and I should have added that myself. However, I removed the link to your page is it is against the rules for posting on the public side. Feel free to PM your concerns to the poster.

          Thank you

            Thank you

Can you link to that rule, the only rule I saw was the one about not making racial comments etc.
