    Does car ridethrough effect warranty?

    If I don't sign a reaffirmation agreement on my 2008 Kia (although I originally intended to), will the remainder of my original warranty still be honored?

    I live in a "pay and retain" state (Massachusetts), am current on car payments, and I plan to continue paying and keep the car after discharge.

    Just wondering if bk ever voids warranties.

    Nothing changes except you can walk away without paying a deficiency. The warranty is good until expiration.

        I too am doing a ride through with my lender. Actually, the lady in their BK department was pretty much "telling" me to do it but not actually coming out and bluntingly saying it.
        No way would I reaffirm a 99' with 50,000 miles and a loan amount of almost $17,000! Yes it's a Mercedes SL500 but who knows if it breaks! I think I will look for something in the $10,000 range after discharge to finance or save money and ay cash. I'm good at finding good deals on cars, LOL.

        11/03/2009 - scheduled 341 - COMPLETED
        01/04/2010 - last day for objections
        01/11/2010 - DISCHARGED & CLOSED

          As one who works in the Automotive business in a capacity to know this, I can tell you that the manufacturer's warranty will stay in effect.

          The only difference might be, an extended warranty that was purchased above and beyond. You see, when a vehicle with an extended warranty is repossessed, the reposessing banker will cancel the extended service contract, and receive a refund of the unused portion.

          I do not see why they could not do the same thing on a bankruptcy, especially if it were a redemption or a cram down in a 13.

          I have also never known a company to do this, but I think that it would be possible.

            Kia is alittle different with their warranties aren't they? Don't quote me, but I believe the original factory warranties with Kia are not transferable, which means it goes to the original owner, not the the vehicle. I would definately check up on this.

              I bought the car new and the only warranty I have is the original manufacturer's warranty that came with it. So if I'm understanding you correctly, bxphae and Never Again, I'm safe, right?

              As for you, Drowning, LOL, we have similar luck with cars, just in different ways. When mine was three weeks old it was rear-ended at a red light by a home improvement store's box truck that lost its brakes. Just about enough damage to total it... but not quite.

              Now, 15 months later, it's sitting at the dealer with its engine torn apart while they try to figure out why it's been burning oil since 4,000 miles. (It now has 15k on it.) Hence the warranty question.

              I'd surrender it in the bk if I could scrape together enough to buy something else, but that's questionable at the moment since my bk lawyer failed to list and exempt the pending injury settlement.

              Ah yes, this whole thing has become quite the adventure.
