    Filing Thur or Fri..A few last questions

    1. Have a tv that is from a circuit city credit card. I owe 1500$. Attorney asked if i wanted to reaffirm. Im thinking no on this as I can buy a tv cheaper then that nowadays. Think they will want to pick it up?

    2. I bought a living room and bedroom set at rooms to go about 2 years ago for 9k(I know stupid) Its about 5000 left on the debt. Attorney asked if I want to keep it. Now this is my bed and sofa and a few other items. I do need a bed but figure i can pick a bed and sofa up for around 1k. Think I should reaffirm or offer a lower amount? or call them bluff and see if they pick it up? Attorney said since its two years old they will pickup. Plus my dogs sleep on this sofa also.

    3. Last question. The day I file im going to have an extra 1000$ in my checking account over my regular pay from a bonus. The Legal Assistant says it doesn't matter what you make in that month you file because they look at the 6 months back not the month you file. Do you think this is true? Also should I be worried about this at the 341 if they ask for my bank statement the day I file? Would It look bad if there was a withdrawal from the account for the bonus money?

    The trustee will ask for your statement which covers the day of filing to see how much cash you had. Make sure you can exempt the amount. As for the other items you have done a good evaluation already...just think to yourself what those items are worth to you right now and offer to pay that amount. I they won't play ball, then give the things back.

      One more thing having to do with question 3. When the trustee asks for you for the bank statement on the day you file....they will be looking at what the balance is of the close of the business day for the day correct? Such as I will be getting deposits in the morning but if i with draw the money the ending days balance will be much less. is this correct?

        Sure the balance will be much less, but the TT will notice a $1000 withdrawal.

        Pay everything early the month you file. We plan on paying our mortgage & utilities early and we will have documentation to prove where that money went. I'm not taking any chances with cash in the bank.

          That's what I did. I paid my mortgage payment early just so I wouldn't have to use an exemption for money in my bank account.

            I have a hard time believing that any company would come pick up your 2 yr old furniture, and probably not even the TV. When I filed in 2000, I had a computer from Best Buy, appliances from Lowes, and a 4 month old set of furniture. I got a few letters from Best Buy and the furniture store, but my lawyer told me to ignore them and they would go away - and that's what happened.

              Can you post the furniture company you dealt with in Colorado? I have a friend filing BK and he's wondering about Furniture Row.

                Actually, that was in TX, and I don't remember the name of it. My more recent BK, due to divorce, was in CO, and I didn't have any secured loans other than my car.
