    Successful 341!

    As I posted in another thread, my 341 went great, but I thought I would post some details particularly for MN, Hennepin County filers.

    In room 1017A of the U.S courthouse, about 4 cases went before me. Only one was at all complex and the trustee was very considerate and professional. They had a lot of property in play and he needed more documentation. They were there with an attorney and the case was continued, but they were told they would not have to reappear.

    My attorney met with me and two other clients prior to the hearing, and totally put our minds at ease.

    The trustee asked everyone for their SS cards and DL's and also for bank statements showing the day of filing and their most recent pay stub. I gave all this to my attorney at the table, the trustee asked me to repeat the last four digits of my SS and handed the cards back to me

    I swore to tell the whole truth and all of that, and I was asked if I had ever filed BK before, the trustee repeated what I made last year and asked what I expected to make this year (his figure was off by a few K I realized when I left the room but the attorney said no problem, I am nearly nine grand under median and he has ALL income documentation). He asked if I made any large or unusual payments to creditors in the past 90 days prior to filing, and if I made any large gifts or payments to family in the past two years. He asked if I had sold anything for below market value. He started to ask about my car, and then said "oh never mind" (no kidding!).

    Then we were done. That was all.

    They are backed up here the attorney said, expect a discharge in 75 days.

    I saw several people there in jeans, not even business casual. I wore plain black pants and a sweater. Parking stinks, but if you are in this county you know that about the downtown area, so come early for that. Building security is tight and the bomb scare they had an hour beofre my 341 was making security understandably jittery, too. Anyway, allow time to get through the security stuff.

    Oh, and one last thing: the trustee accepted a 1099 from a guy who did not have a SS card, so no worries there either if you need to do alternative documentation of SSN.

    What a relief!

      Glad it went well! Thanks for the detailed info.

      BTW, that location covers more than just Hennepin county. It looks like it covers Anoka, Carver, Chippewa, Isanti, Kandiyohi, McLeod, Meeker, Renville, Sherburne, Stearns, Swift, and Wright counties, too (in case anyone is wondering).

      I know the parking won't be great, and our meeting is at 9 AM, so we'll have rush-hour traffic, too. I think we're going to take a bus from a park-and-ride instead and let someone else do the driving.

            On the backup in MN, is that just for Minneapolis cases or is that for the entire state? And is part of the backup related to resources being used for the Denny Hecker case?

            I would be filing in St. Paul.

            CityFarmer: You may want to consider taking the light rail in from Ft. Snelling or 28th Ave. stations especially if you are closer to the south metro. No need to deal with freeway traffic. Keep in mind that at Ft. Snelling, the north end of the platform is still closed.

                  Congradulations.......I have one question though..isn't the "look back" period of gifts or payments to fsmily only suppoed tp be only one year? if its 2 years I have to still wait to file........OH NO!

                    Talk to your attorney on that, I would not worry. I think in a few circumstances it can be 24 months, but not most.

                      I think if you are filing in St Paul the back up may not apply to you. The economy is so bad though don;t be surprised if it does. I do not make a lot, and I was the rich person in the room. Hearing other people's income made me feel so bad for them. The Denny Hecker case being partly to blame is an interesting point! A friend in Boston told me that guy was making national news. Wish I could take 26K vacations and call myself bankrupt!

                          In most districts the look back period is two years.

                              Denny Hecker files for Chapter 7
                              bankruptcy

                              Fallen auto magnate Denny Hecker filed a
                              personal bankruptcy petition Thursday, the
                              culmination of a yearlong slide that has left him
                              owing up to $1 billion to automakers, lenders,
                              business partners and former employees.

                              The Chapter 7 bankruptcy petition filed in U.S.
                              Court in Minneapolis had been widely anticipated.
                              Hecker has been forced to sell or close 25 of his
                              26 dealerships in recent months, and Chrysler
                              Financial won a $477 million court judgment
                              against him in April. The bankruptcy filing
                              temporarily halts efforts by Chrysler and other
                              creditors from collecting money they say they are
                              owed.

                              In an interview with the Star Tribune late
                              Thursday, Hecker said he delayed filing for
                              bankruptcy in a futile attempt to reach
                              agreements that would satisfy Chrysler and other
                              large creditors.

                              "We did the best we could," he said. "It's
                              unfortunate. I just don't have the money" right
                              now.

                              Hecker has blamed his downfall on the economy
                              in general and the horrific fortunes of U.S.
                              automakers. Hecker was a big customer of both
                              Chrysler and General Motors, which have both
                              entered bankruptcy in recent weeks.

                              Specifically, Hecker pointed to his 2006 purchase
                              of Advantage Rent-A-Car from then-
                              DaimlerChrysler AG, which agreed to finance the
                              deal. Hecker said that business lost $35 million as
                              he grew it from $150 million in revenue to $300
                              million over two years.

                              After Cerberus Capital Management bought
                              Chrysler from its German parent in 2007, Hecker
                              said, he started to get pressure from Chrysler to
                              sell the Advantage business and reduce his debt
                              to the automaker. Hecker said he was close to an
                              agreement to sell Advantage to Hertz for less than
                              $100 million in late 2007 when the bond market
                              and travel industry started to sag. Hertz walked
                              away from the deal.

                              "In my heart, I believe somebody at Cerberus or
                              Chrysler in New York, said, 'We need the money
                              back. This guy owes us $500 million and our next
                              largest customer owes us $150 million.' That was
                              the tip of the iceberg," Hecker explained. After
                              that, his other lenders started calling in loans in
                              2008.

                              At one time, Hecker's sprawling dealership
                              network claimed annual sales of almost $7 billion.
                              The face of the high-energy pitchman, who
                              started selling cars at age 19, graced billboards
                              and bus sides across the metro area. He hob-
                              knobbed at pricey restaurants, jetted to Mexico
                              on weekends or reposed in his $12 million lake
                              home near Brainerd.
