    Trustee Report & Pacer Question

    Soooo.....I logged onto pacer this morning and low and behold there was a Trustee Report from my 341 last week....

    "Chapter 7 Trustee's Report of No Distribution: I, XXXX XXXXX, having been appointed trustee of the estate of the above-named debtor(s), report that I have neither received any property nor paid any money on account of this estate; that I have made a diligent inquiry into the financial affairs of the debtor(s) and the location of the property belonging to the estate; and that there is no property available for distribution from the estate over and above that exempted by law. Pursuant to Fed R Bank P 5009, I hereby certify that the estate of the above-named debtor(s) has been fully administered. I request that I be discharged from any further duties as trustee. Key information about this case as reported in schedules filed by the debtor(s) or otherwise found in the case record: This case was pending for 1 months. Assets Abandoned: $84998.00, Assets Exempt: $156722.00, Claims Scheduled: $425728.60, Claims Asserted: Not Applicable, Claims scheduled to be discharged without payment: $425728.60. "



    I am just so happy. Even though we have 7 or so weeks until discharge this feels GREAT!

    So now onto my questions:

    1. Is there any reason to still check pacer on a weekly basis? Would I be able to see any creditor disputes on it (if there are any)?

    2. My atty said he usually has received reaffirmation papers by the 341 meeting. He had yet to receive any from my creditors (2 mortgages on house and 2 car loans). I know that reaffirmations can come at any time until discharge but how likely am I to receive any at this point? I am hoping to NOT receive any and do ride thru on the house and both cars.....

    WhooooHoooo!! Did you every expect to be happy about NOT having any assets?!? Once I saw my Trustee's Report of No Distribution, it was a BIG relief and although there was no need to check Pacer, I still logged on everyday...just to make sure everything was okay (creditors can still dispute within this time).

    What did your attorney put down as your "intent" on your petition. I put "will remain current" and I did not reaffirm anything. Are you dealing with any Credit Unions?
    May 2008 Hired 1st Attorney/Stopped paying CCs
    May 21, 2009 Retained 2nd Attorney
    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!

      Where would I look on pacer to see creditor objections?

      OMG, it feels so good to not have assets right now! I am on cloud nine and feel such a relief. No more crying over bills every week!!! I just wonder why I didn't to this sooner! I guess like everyone else I didn't want to admit we were in over our heads and thought we could manage enough to get by.

      We marked that we intended to reaffirm. But we have since changed our minds.

      Yes, our (old) credit union holds our second mortage and both our vehicle loans....should I be worried?!?!? I have heard credit unions are difficult......

          Once you log into your Pacer account, just look for the date of last filing. That will show you if anything has been filed. That way you won't be charged looking at the docket for no reason.
