    PACER updates question

    Our deadline for creditor objections is tomorrow. If there is nothing new filed on PACER by the end of the day tomorrow are we okay or does it take a few days for PACER to be updated?

    The reason I ask is because my dad is one of our creditors and he sent his lawyer to our 341 and to the UST, which has caused a bunch of trouble for us. I am afraid he could file an objection since he has fought us this hard so far.

    Can a creditor get an extension? I thought I read that on a thread recently.

    A creditor can get an extension for "cause" but the motion must be filed within the 60 day period. The attorney could file one minute before the expiration and the court would have to decide. I know it is a terrible thing you are experiencing but just hang in there as there is nothing else you can do except just hope.

    Just an add on. Are you sure this gentleman is your "DAD?"

      Thanks. Can you give me an example of what "cause" would be?

      Also, will PACER update this information as soon as it is filed?

        PACER updates every night but if you sign up for electronic notification (free) the BNC will send you an email every time there is any change to your case.

            Go to the District Court web site and there should be a form you can down load and mail in. I file mine along with the petition so never had to go fishing for info

            I need to add, this is for pro se filers only.

              Thanks. I think PACER will be sufficient.

              Can someone tell me what is considered "cause" if a creditor was to file for extension of the 60 day deadline? Thanks.

                IMO, "cause" is usually a showing to the court that there is more information to get and that they "diligently" tried to get that information with the allowed time period (60 Days) and were unable to.

                  MSbklawyer said once that if someone asks for an extension they can get it very quickly unless you respond quickly and object. but i think such requests are quite rare, and if they are filed they are filed mostly by trustees, not creditors.

                  if your dad has a lawyer, then that lawyer is required to file electronically. that means that if they file something, you will see it on pacer in real time.

                  check your local rules to see whether their deadline is 5pm or midnight...

                    Good to know, thanks much. One more day to go....holding my breath.

                    If my dad's lawyer does not object (I don't feel he has grounds to) then he will be out of the picture. That would be one hurdle we overcame. The next is the UST. Here's hoping......
