    Creditor List

I have compiled my list of creditors using both our credit reports and a stack of bills I've been saving for a special occasion. I have a couple of general concerns.

    1) What if there are creditors sitting out there, not reporting, that I miss? Maybe one that we haven't heard from in several years? I know we've got all the 'major' ones, but I worry that something is going to come out of the woodwork after we file.

    2) I have some medical bills that are all for the same creditor, but each uses a different account number. Do I need to list all of these separately on the mailing matrix (the court web site specifies listing the account number with the address) and on the schedule of unsecured claims? I'm hoping I can just consolidate, but its not a huge deal if I have to list them all.
Filed pro se (ch 7, no asset) 10/27/09
    341 12/14/09
    Discharged 03/29/10

It's always possible that this can happen.

If the creditor contacts you while your Ch 7 is still active, you can add them to your creditors list by paying $26 (I think that's the amount) to the court.

If the missed creditor appears after discharge, then most (but not all) bk districts have ruled in a no-asset Ch 7 that a debt that would have been discharged if it had been included is considered discharged even if it wasn't included. If you are filing with a lawyer, he/she can tell you if your district is one of these.

Depending on the state the debt originated in, sometimes the statute of limitations to collect the debt has already passed and the creditor can't pursue the debt any longer.

If the missed debt is small enough and shows up after discharge, some filers will just pay it and move on.

I would follow your local bk court's instructions and list each account number separately.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
