    how long to wait

    My wife and I planned on filing chapter 7 this month in the Western District of Missouri. We have saved enough for the lawyer, have our debts listed, our proof of income for the last 6 months, and I think I can exempt both autos using combination of auto, tools of trade and wildcard.

    Then BOOM, my wife suffered from a brain bleed. She is fine now, but was in the hospital for 2 weeks. She spent 1 1/2 weeks in the nuero ICU and i'm sure that it will not be cheap. She has a follow up app/test in 6 weeks and if all goes well the Dr. said there is a very very small chance of this reacurring.

    Then I get a call from my Dr., my thyroid levels are out of whack (stress induced i'm sure) and blood in my urine. He has ordered tests to make sure everything is ok. I had 1 test yesterday and 1 today for thyroid and 1 test at the end of the month with the uroligist. Once again I'm sure these tests are not cheap.
    We both have insurance with a total of $3000 out of pocket expense.

    To include these bills in my chapter 7 how long should we wait to file.
    We have 2 of our ccs that we haven't made a payment on since Feb 09.

    You can file tomorrow...medical bills are not a problem. You may want to wait to see if everybody is healthy and no more bills are forthcoming.

      I plan on waiting until at least after her follow up with the nuerosurgeon in mid November. Hopefully that will be the last of her health issues.

        So very sorry to hear about the health issue.

        If your only concern is the medical, I would wait as long as possible, even well beyond the neuro visit. Medical companies tend to wait longer to sue, in my own experience.

        You may be well advised to wait even longer if possible, if any recurrence or side-effects are a remote possibility.

          When an entity decides to sue doesn't matter only when the debt was incurred. If you feel confident that the medical issues are over and done with and you are otherwise pressured from creditors, medical or otherwise, then file BK once someone is about to get a judgment on you. List every single entity you could possibly owe money too, even if you think your insurance should pay it whether you have a bill or not.
