    How long do you think?

    I filed as a no asset case, and had my 341 this past Monday (10/5).

    There is a chance that the TT may want to reclassify me as an asset case (that's OK, I'm kind of expecting it)......how long might it be before that decision is made do you think? And how do I find out? Will it show on Pacer? Will the TT send a letter? Flowers? A box of chocolates? At least give me a kiss before he? ..... * ahem - probably not an appropriate comment for the board *

    I've been checking pacer daily since monday (and yes, I realize it's only wednesday - but I'm an OCD kind of person)..and nothing yet. I also don't want to make my attorney miserable asking him (he's in court all week anyway), and since I'm an OCD kind of gal...I can't stop thinking about it.

    Hi last2cents: I understand the OCD all too well.

    To try to answer your question, our attorney told us we were over our exemptions, so it was no surprise when we were ruled an Asset Case. I just don't remember the entire time-line w/o digging out all the paperwork.

    We filed 12/28/2007, and had the 341 on 2/7/2008. I believe our original 60th day would have been somewhere in mid April, perhaps around the 12th. But, as I recall, we were ruled an Asset Case about mid-March. Paperwork went out via PACER and snailmail to all creditors concerned that "assets had been found" and the date for Creditor Objections had been pushed back to June 12.

    I remember that date well, because 'Hub and I were watching for the magic D word. No sign of it came until we called our case worker about it on August 13, 2008, who told us that the only thing lacking was a copy of our Marriage License--which we had with us at the 341, but TT didn't need it--[grrr!]. Once that was sent, we got the Discharge that day. We still are not Closed.

    Understand that this is a very abbreviated time-line. There were other motions and things going on with our case on PACER and with the Court that we had to agree to, such as agreements to purchase your assets back from the BK estate. Several of those went on, and you may have them too, depending on your situation.
