Chapter 7 and a USDA foreclosure
My husband and I are currently filing for a Chapter 7 bankruptcy. Our house was foreclosed in June of last year. The mortgage for the house was through USDA Rural Development. We are in a rush to file Chapter 7 because we got a notification from my husband's payroll department last week that the USDA was going to garnish his wages starting this week. We have NOT received any judgement or garnishment from any court and have not been served with any papers. Our lawyers are asking for the judgement and there is no record of one. The USDA will also get our tax refund when we file next year (without filing bankruptcy). We are a family of 4 and our income is below the $71,000 for the means test.
