    One of my student loans is on credit report as INCLUDED!

    I was discharged in Aug.

    One of my student loans- Sallie Mae- is showing up as included in BL with all balances showing zero. It's also in the "closed acct" section of the credit report.

    My other student loans, though, are showing up Open with all their balances and etc.

    Thoughts? What the heck? Dare I hope?

    Do NOT dare to hope. There is no accidental discharge of student loans. Unless you filed an adversary proceeding to determine dischargeability of the student loan, it is still a live debt. Your credit report is not a legal document that indicates the legal status of a debt.

      Sallie Mae is one of the home loan 'critters'--sorry I can't think of the proper term--but they buy and sell other loans. This is much like when we BK-d on our MasterCard, it's parent company owns(ed) Radio Shack as well, and when after the 341, we bought a small item at RS, and fully expected to pay--THAT debt was wiped out. There was absolutely no record of it anywhere.

      So if I were you, I would be a good kittykat and fold my paws and *pretend* to go to sleep.

          I don't like disagreeing with HHM, who is very knowledgeable. I simply told what happened with us. Understand that our situation did not include a student loan.

            All of my student loans are marked as zero balances and included in bankruptcy. This does not discharge them. If the lender so chooses, they will change the status back on your credit when you start making payments again.

              Mine are also marked IIB and have zero balances. I did not for a second, nor do I now, believe that they are gone.

                So if, for some reason, this student loan was in fact discharged, where in the court docs would this fact be actually reflected/recorded and would there be any further liability for it?

                  As HHM says, student loans are never automatically discharged. You have to have a AP trial to fight to get them discharged and very very few people win those AP trials.

                  So the short answer is that nowhere in the court docs would the discharge of the student loans be reflected because student loans are never automatically or mistakenly discharged.

                  They are often misreported on credit reports however.

                    Mine are all listed as included and are at zero now, and it couldn't be father from the truth! It'll re set soon. Sadly.

                      Backtoschool, thanks for bringing me back to earth... I was hoping that, somehow, an occasional SL would somehow slip into the discharged column.

                        Believe me, I sympathise bf2bf! I have over 100k in student loans that will be joining me in my "fresh start".

                            Oh don't get me wrong, I am very very grateful for my fresh start!. Bankruptcy has changed my life for the better in so many ways, and I am deeply grateful to be able to hit the reset button and try again to add value to others while also finding meaning in my life. I just feel like these student loans will be with me the rest of my life.

                            I am going into the public sector after getting my second graduate degree, so hopefully I will be able to get them forgiven after ten years of working in my new field.

                              Backtoschool, you seem like a really good person... By "bright side" I meant that now you will be able to afford a bigger Gucci bag for all that baggage.
