From what I have read, it is better to modify before or during bankruptcy if you want to keep the option open to walk away in the future if things arent going good for you. If you sign a modification agreement after you have filed, you are entering into a new contract with the lender.

I highly recommend going through the HAMP modification before filing BK. Once you are in the process of the HAMP-modification and you file before it's finalized, your lender won't continue working with you when you file. As mami2four pointed out, applying for HAMP during BK is also an option.
A discharged BK doesn't mean you don't quaify so that would be your third option.

my hubby tired to apply for this before we filed. One of the main reasons we had to file was the fact that they would not entertain the redo since we were current. Good luck to you.
I was offered a modification before I filed. With my mortgage one had to be 3 mo behind. They wanted a $5000 deposit and then would have lowered the rate tremendously. I did not have the funds for the deposit.
So I filed BK, and then by this time was way behind but then was able to get into the Homeowner's Affordability Plan. I am 6 mo into the plan but still have yet to receive final paperwork.
