Okay, I am unable to obtain a new car loan partially because my case hasn't been discharged yet (80 days and waiting). My lease ended Monday, but I have not called them to let them know I couln't get a loan to buy the vehicle, because I know they will want me to turn it in. I need my car, obviously. Can they come pick it up even though I am still in BK? Would they have to file a motion for relief of stay?

I wish. When I called them last week to find out my options, the first person I spoke with started to go over options, then when she tried to access my account, it was blocked. She had to send me over to another department. Well, the lady in the "other" department wasn't very nice or helpful. My two options where to find my own financing or turn it in. I paid my lease obligation up to the end and they still couldn't offer finance me. I tried with a couple of lenders, but "no"! So, I will have to go to one of those "we can finance anyone" used car dealerships with limited choices. But, I don't have money for a down payment and my BK is not discharged. So, it is a waiting game, but I don't want the leasing company to come pick-up my car yet.5/29/09 ~ filed chapter 7

I am not discharged, i am in the 60 day club. I have a lease car thats lease was up on 9-30. I talked to them last week because their inspection company kept calling and I wanted them to quit ( I couldn't tell them when they called because they kept leaving messages on my voice mail when not at my work desk, so I called them back) When I talked to them they claimed not to know about me filing and asked if I was giving the car back now, I told them that my attorney said nothing was supposed to go on right now as there was a stay in affect and that unless they were to motion for a relief of stay that I wasn't doing anything. They told me "OK, we will do whatever it is we need to do " Honestly, since I am in the middle of my 60 days and it would cost them to file a motion that they may just end up waiting until I am dismissed and then come for the car. I would check pacer regularly for a motion for relief of stay and until I were to see one I wouldn't worry to much about it.Southern District of Florida
