Do credit card companies show up to 341 meeting?

    Do credit card companies show up to 341 meeting?

    I am filing Chapter 7 and am headed to my 341 meeting. I have 1 credit card which was last charged I believe about 4-6 months ago to get my teeth fixed. It is one of those Care Credit cards.

    Does anyone know how often these types of credit card companies show up for these meetings? I am worried because I read that if you made any charges 6 months before it could be dismissed or something to that effect.

    Necessities are not an issue. As long as this was needed dental, and not a diamond grill, you'll be fine.

      Actually, the look back is usually about 90 days on the cards. Luxury items you charged and never made a payment on (in particular) can create problems.

      I had some small charges about five months before filing, but continued to pay on those cards for three months. I was told it should not be a problem.

        I was worried about them showing up and one even sued me, and they are in the city I filed...But noone showed up for mine.

        The 341 meeting is about 3-4 minutes long and easy as pie unless you lie ;)

              K one other question. We were buying our house. We filed in August. The lawyer told us we have about 4 months in the house. Does anyone know if that is actually the case? We have somewhere to move to, but not until Dec.

                The exception is credit unions. Local credit unions will show up quite frequently to 341's. At my 341 there were several credit unions represented there. (not for me, my ex-credit union is at the other end of the country. )

                  Before foreclosure? That's up to state guidelines. These days banks are taking their time though. Some are taking over a year. YMMV.

                    Wow. That's incredible. I guess if there is a backlog that could be the case. I'm sure there probably is right now with things like they are.

                    Well, not sure if I mean until foreclosure, but how long after the bankruptcy do we have until we have to be out of the house. Did I say it right?

                    And honestly last month was the first missed payment for the house, so we do probably have until Dec. I was just wanting some reassurance I guess. I am just a little freaked by all this.

                      I'm not sure what you mean by "we were buying our house". Do you have a land contract, mortgage, rent-to-own agreement?

                      If you have an existing mortgage, your lender will need to follow the foreclosure process. Bankruptcy doesn't disrupt this process (although, it can delay it). Your foreclosure timeline will depend on State laws and your lender's actions. In some areas and with some lenders, the foreclosure timeline has extended.

                        It varies. I had five different accounts with Navy Federal and their headquarters are about 20 minutes from the court house. They never showed up or disputed anything.
                        6/12/09: Filed Chapter 7
                        7/21/09: 341 Hearing (went very well)
                        9/28/09: Discharged
                        10/2/09: Case closed!

                          Yes, we have a mortgage. Sorry for the misunderstanding. We were not late, we paid August's payment, but not September. We filed bankruptcy in August. I was just wondering if the meeting of the creditors had anything to do with or if they would tell us then when we had to be out of the house.
