    Met w/Atty, confused

    So I met with a bk attorney today who used to be on the other side of the table, as a chapter 13 trustee. I am considering a 7. He stated a few things that I would like another opinion on, as they were counter to my understanding:

    1) Any payments made in the past 12 months toward loans from family members must be paid to the trustee by me or the family member, or the family member will be sued. It doesn't matter what size the payment(s) are or the fact that I have not been late to any creditor thus far. (The repayments I've made to family are a few hundred here and there... a few pebbles to my monthly debt mountain) He said he's never seen a trustee allow the payments.

    2) Even if I qualify for a 7 without the means test, the trustee will tell me I can't send my kids to private school. It appeared to me that he agreed with this.

    3) If I start making $ after the filing but before the 341 I will be pushed into a 13.

    4) I can't state my intention to reaffirm a debt then not sign the agreement. He said either you reaffirm the car & mortgage or you don't. If you don't sign it, you must surrender it. He said you cannot do a ride through any longer.

    He didn't seem thrilled that I didn't want to file a 13. He answered my questions, but didn't offer anything unless asked. I don't need a shoulder to cry on, but I couldn't tell if he was no a 'no nonsense here's the facts' guy or if he was looking at me with his trustee hat on.

    Perhaps his statements are accurate, but I think I will speak to someone else.

    It's always a good idea to talk to a few. In this case it's mandatory.

      It sound to me like the atty forgot to change hats. I just came out of c7 where I stated I would reaffirm my car loan. I didn't and NMAC allowed me to ride through & I just rec'd a letter from Nissan stating I was not obligated to make any further payments as the loan had been IIB. However, should I desire to keep current and receive monthly statements, sign below and return. The ride through depends on the creditor.
      Filed Ch7 5/28/09 (Pro Se) Orlando, 341 7/01, UST selected case for audit 7/01, Last day for objection 8/31. Audit report filed 9/10, no material misstatements. Discharged and closed 9/22/2009

        Forget this lawyer! You need someone who is going to be on your side and help you along accordingly. I went into my 13 2.5 years ago with a lawyer and staff who never offered up any info or suggestions, and I was very unprepared for my 13. I didn`t know what questions to as ask, as I hadn`t found this forum. Things have changed and I`m converting. My new lawyer is like night and day from the last. Trust me, find a lawyer you are comfortable with, and that is there to help YOU.

          Your assessment of the interview sounds right - it sounds like you need a true 'debtors attorney' rather than one that is a former/current trustee.

              You need a second opinion pronto!
              4/09 Converted to a Ch 7 due to loss in dh's income
              5/09 UST now involved no idea what happens next
              7/09 UST has decided to withdraw his motion to dismiss!
              7/27/09 DISCHARGED!!!

                I agree with the other posters....consult a few more attorneys.

                  RUnnnnnnnnnnnnnnnnnnnnnnnnnn!!! oMg... please interview a couple more atty than have not been a trustee... my kids go to a private school and still do....but please listen to others as well....
                  chpt 13 11/25/08 converted 7/7/09 to a 7. No assests and surrendered vehicles...
                  9/2009 Scores 515-565 & working up from here...10/9 they havent budged yet....why does our puppy & bk lawyer have the same name...lol Discharged 10/28/09 now the real work begins
