    2009 tax return ????

    My bk case will be closed in Nov.....

    Do I have to report my 2009 tax return to the Court next year? Or can I just file my taxes online like normal and keep whatever refund I get. My lawyer estimated $300 (exempt) on my petition but let's say I get $1000...do I have to report that to someone?

    Just thinking ahead....

    My TT made it clear that he wanted to see and speak with my attorney before we cashed our refund check. He even made us sign a document. I would say that if you did not get instructions from him about your tax return then you are OK. He specifically told us it was because of the size of our return which was over $5,000 last year because of losses we could still claim from Katrina.

      We are getting to that time of year where the BK trustees are keeping cases open to see your 2009 tax return to see if there is any portion of a refund they can snag.

      Most trustees have an instruction sheet about this or will otherwise notify you.

        We were discharged in July. We were allowed to keep this year's return and my lawyer said we will be able to keep next year's also.

        Ask your lawyer and see what he thinks.
        4/09 Converted to a Ch 7 due to loss in dh's income
        5/09 UST now involved no idea what happens next
        7/09 UST has decided to withdraw his motion to dismiss!
        7/27/09 DISCHARGED!!!

          Good thing I have foreign income. No tax on my small income, which usually means no refund either.
