    Questions prior to filing--new to this!

    I have some questions and if anyone could offer any answers, that would be great.
    -Will we file two tax forms for the year?

    -If we are going to make charitable contributions, should we hold off until we file bankruptcy?

    -I have a pension pay out that I was considering taking. Would that be considered income or should I wait to cash it in until after our bankruptcy is closed.

    -Is mileage, print reimbursement for my job considered income?

    -We are going to get our taxes paid (we owe both property taxes for this year and state income taxes for this year, BUT will there be any issue regarding filing bankruptcy and this?

    -I really would like to try to have our school loans included in the bankruptcy. We owe over 65,000 and our payments are going to be $450 a month for 30 years. It will cause a hardship in our finances if we have to pay this.

    No. What makes you believe that you would need to file two tax returns each year? Actually, I don't understand the question, as you ask if you have to file two tax forms.

    No. If you file bankruptcy and aren't actively making charitable contributions, they will be denied.

    Yes, that's income. You should probably wait to take any distribution. Pension funds and other ERISA type plans are exempt assets. Don't change an exempt asset into a non-exempt asset!

    The question I would ask, is... does this reimbursement show up on your W-2 and/or paycheck as "wages", or is it separate?

    Unless you have suffered a tragedy that won't allow you to ever work again... your school loans will not be discharged. In any event, to discharge them, you'd need to file a formal complaint (adversary proceeding) and prove that you have no way to pay the loans in your lifetime.
