No, it's not a community property state. So I'm wondering what the Trustee is up to.

Most of the times they are, but when it comes to property that changed hands in the several years preceding filing... Trustees get interested. That's because they make absolutely no money if they don't find anything. (Panel Trustees get about $25.00 per case, so if they don't find anything... they are wasting money by spending time on them.)

Oh and ( because the way I phrased the question) do you mean that the home would be half mine again after marriage or not ?
That is probably the question the Trustee wants to answer! I personally don't know, but I'm guessing that you now "may" have an ownership interest in the property. The homestead exemption in Indiana is pitiful ($7,500 or so), and if you have a lot of equity in that home, then the Trustee may be after "half" of it -- less the $7,500 exemption. Just my observation.

      No Equity

      Thanks again JustBroke
So If the trustee finds that there is no equity in the home ( and this is what he is after) will he drop it ?

I think the UST already believes this to be the case. That's why he asked permission to hire an attorney. Should be interesting. So, is there any equity?

I don't think so. If the Trustee is only just getting an attorney appointed, I don't see that anything else happened yet.

                O.K. now what ?

I got a letter today that said that the trustee filed for extension and that it was not contested but that he has already filed a report of no distribution so my extension is no longer needed.

any clues to what this means ?
