    Gambling Winnings After 341

    Hello everybody, this is my first post on this forum.

    I filled bk on 08/19 (unemployed, no assets) and had my 341 meeting on 09/17, and everything went well.
    This week, I remembered that I have $45 on an online poker site (used to play on 6 different sites), entered a poker tournament and won it for over $1500.

    I would like to withdraw that money, will the Trustee have a problem with this?

    Paycheck received after filing date?

    I am planning on filing around Jan 6th. I am under the means test and have negative disposable income but still earn about 5 thousand a month but don't get paid until the 9th of each month. Can anyone tell me if I will have to include this income I receive after I file on Jan 9th as income for the 6 month look back if it actually wasn't paid to me until the 7th month and will I have to give any of this to the Trustee, ie 25%? I just don't want to feel like a bother to my attorney although I shouldn't feel that way. Appreciate any help on this matter. Thanks.

        Technically speaking, in a Chapter 7, any money you receive after filing, is basically yours. There is one exception. That is for money that was bequeathed to you, and inheritance, proceeds from an insurance payout as a beneficiary, or insurance settlements. Everything else is yours.

        So, technically, you don't have to report it and the Trustee doesn't get their hands on it. To be sure, contact your attorney, but he should tell you the same thing.

            BarcaFTW, the question is: when did you win the $1500? it sounds like you are saying that you just now remembered it. if you just now remembered money that you won prior to filing, then you were supposed to report it on your schedules. if you won it after filing, then i agree with justbroke.

              $1500 is not enough to really worry about. You may want to wait till discharge before cashing out the account just to be safe.

                I won the $1500 after my 341, anyway, checked Pacer today and saw the TT report of no distribution-no funds....so everything is okay.
