    Lawsuit threat

    My husband just got a letter in the mail from a lawyer by the name of
    Daniel N Gordon, he is threatening to sue him for $3500 for a debt by Applied Card Bank, the last payment made to Applied was in Jan 09. We are supposed to be filiing CH7 in November, do you think Gordon will have his lawsuit filed by then. We havent spoken to Gordon, I googled him online and he is supposed to be a complete a$$. The letter asked my husband to make a payment within 30 days or he will be sued. I am worried that he will file a lawsuit and his wages will be garnished. We are struggling right now on one income. What are your thoughts on this?

    He could sue you today and I doubt you'd have a court date by Nov.
    You have several weeks to respond to any lawsuit{depends on your state law}.

      I got sued in April of 2009..
      They got a default Judgement in June...
      I filed Bankruptcy in August.
      Had my 341 meeting last week...
      Though in bewteen I lost my job in June so they couldn't touch my money.

      I wouldnt worry about it...Plus I think the trustee will go after the money they garnished anyways....

        By the time he sues, you will have filed. If that happens, put the attorney on the list of creditors.
