    Question about pacer update

    Our origional 341 was August 18th...it was continued to September 1st in order for us to submit corrected schedules that our attorney had messed up. Our atty did not submit the corrected schedules until two days before the second 341 and the trustee continued that (over the phone, we did not have to go) until October 6th. I just looked on Pacer because our atty had told us that she was hopeful that we would not have to go to the next 341 that the trustee would make her judgement with the amended scheudles and that would be that.....well this is what I found on Pacer today...

    Clerk's Notice to Debtor(s) re: Personal Financial Management Instructional Course. The debtor(s) certification of completion for this course has NOT BEEN FILED. If the certification is not received by the last day to object to the discharge of the debtor, the case may be closed with NO Discharge.

    We have not done this because our status still says "awaiting first meeting"...I thought we had 45 days from the 341...is that our origional 341? The second one...we never attended...or the third one that we may or may not have to attend? I don't want to do it too soon and peeve off the trustee...but I don't want to miss the deadline..which would technically be October 17th. Also, will our discharge date be October 17th? Or December 6th? I'm very confused! I know that the creditors date to object on Pacer is still October 17th....

    Hi Berrymom,

    I was under the impression that the 2nd course had to be done before discharge BUT our attorney (and the Trustee I guess) wanted it completed before our 341!!! I guess it just depends, if I were you, I'd complete it by this weekend. It's only like $15 bucks or so and you get the certificate instantly.
    May 2008 Hired 1st Attorney/Stopped paying CCs
    May 21, 2009 Retained 2nd Attorney
    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!

      Thanks..I just talked to my atty and she said it had to be done 45 days after the origional 341 date....so, I just enrolled for one online..I wish I had asked first! The one I just paid for is $24.95 for me and another $24.95 for my hubby!

      She also said that if the trustee desided to rule before the next 341 date or if it went smoothly...then we could be discharged as soon as 30 days after the Oct. 6th date...that basically the time for creditor objection was still the origional time frame!
