california mechanic lien

I took my car to the shop and it took seven months to fix it with a used motor. I paid total of over 5000 dollars. Now, when I pick up the car I issue a check of $700.00 and it bounce. Now the shop is threatening a lien on the car. I planing to file chap7 in December, can I include the lien in chp7? The car is already paid off and probably value at less than $4000.00. Thanks in advanced.

depends on the lien. if they perfect it before you file, then it will survive your bk unless you can exempt it and thereby avoid the lien. maybe someone else can chime in with more details.

They could possibly turn the bad check over to your state's attorney general, and if that happens bankruptcy won't fix it.
