    Checking accounts and Trustee

    Hello Everyone,
    I am in the beginning stages of filing BK and am on severe sleep deprivation due to the stress of it!

    I just met with the lawyer and got the list of things I need to gather and the huge packet to fill out.

    I have on area of major concern though. It asks me to list all bank accounts open or closed for the past year.

    Here are my numbers:

    open:
    check acct 1: bal 98.33
    check acct 2: bal -97.19

    closed accounts:

    acct 1 closed 6/15 ending bal 800.00
    acct 2 closed 7/13 ending bal -918.90
    acct 3 closed 12/22 ending bal 30.00
    acct 4 closed 12/22 ending bal 101.00

    I am worried sick that having all these accts (open and closed) is going to send HUGE RED FLAGS off in the trustees mind.

    Any input?

    What if I miss an account....as I am not sure I have remembered all the accounts. If I fail to list an acct how will the trustee find out and what will happen to me. If I have forgotten an account it will not have any type of balance in it...as I am broke, have no $$ to have in there!

    Any advice or help would be greatly appreciated.

    I closed one account, and opened a new one a few months before I filed bankruptcy.

    I don't even think the trustree actually cared, I had .85 in it...

    And for the record I took out at least $600 each month before I filed...Maybe the 6 month look back was up though...But the trustee didn't mind...

      don't worry. they ask these questions to find out whether you have hidden assets. for example, if you closed an account less than a year ago and the ending balance was a million dollars, they would want to know where that million went. so closing a few accounts is no red flag in my opinion.

      just remember to list the banks where the balance was/is negative as creditors.

      it's not a big deal if you forget an account, unless of course it had a million bucks... i don't know how the trustee would find out, whether they have some kind of law that allows them to search for a person's accounts or not. no idea.

        Thank you for the replies. I found this board last night and couldn't stop reading through all the post for a good three hours! I am so glad I found this site. It has been very informative and made me realize that I am not alone with the concerns I have.

        As I have told my lawyer and family--the thought of filing is scaring the hell out of me. I have two children that each suffer from major medical issues and the totality of the debt and creditor calls have become too much for me. I would love to just have to concentrate on their medical needs and not worry about anything else. But getting there is stressing me big time!
