    Discharged today 9/22!!!...QUESTION though????

    PACER shows my chapter 7 discharged today 9/22/09.
    I'm excited....but I filed a Honda reaffirmation agreement
    yesterday and the court didn't get it in time. Honda still says they are going to file it today....which should show on PACER tomorrow 9/23/09.

    My question is: Won't the judge have to re-open my case in order to sign off on the reaffirmation agreement? Is this going to mess things up?
    My lawyer and I signed the reaffirmation agreement that it's not a hard ship....but my income did go up since the 341.

    (I want to reaffirm because: $5,000 equity in car, want it to report on credit reports, only car, reliable car, low payment/rate etc...)

    Congrats!!! I'm not sure on your question, hopefully someone else here knows more. But a discharge doesn't mean the case is closed yet. I have been discharged and am still awaiting the case closure, so unless Pacer shows your case as closed, it is still opened (even though you are discharged of the debts).

      Was your case CLOSED or just discharged? Either way, it's no big deal. The worst thing is that you have to pay a reopening fee which is the same as the filing fee.

      Here's what the code and the rules say about it:

        Congrats on the discharge!!!!!

        I think you were just discharged (I could be wrong ) not closed, so I don't think it's too late to add the reaffirmation agreement to your case. Good Luck!

          Thanks for the replies.
          Correct. I have been discharged and NOT closed.
          I am getting nervous because other sites are saying, "you only have up until day 60 from your 341 meeting to file a reaffirmation agreement."

          I am willing to re-open the case...and pay the fees.

          I hope I can figure this out. (My laywer had NEVER filed a reaffirmation before!)

            We were told that our reaffirmation had to be filed BEFORE the discharge. You may have to reopen your case.

            5/09 UST now involved no idea what happens next
            7/09 UST has decided to withdraw his motion to dismiss!
            7/27/09 DISCHARGED!!!

              On the Reaffirmation, if you have been making your regular payments all along and are current on your payments, reaffirming now could just be a moot point.

                for all of the answers and the congrats messages! It feels great!!!
                My case probably won't be "closed" for a while....the trustee at the 341 told everyone to turn in our upcoming tax returns (if any) to him.
